Article 1 – Purpose

These General Terms and Conditions of Sale are governed by Article L. 441-6 of the Commercial Code and comply with Article L.111-1 of the Consumer Code. They aim to define the reciprocal obligations of the parties as well as the different steps of the ordering process for the sale of any product presented on the website peche-chasse.fr by the company EI INNOV-TECH.

By validating their order on the website, the Customer declares that they have read, understood, and unreservedly accepted the terms of the order as well as the entirety of the General Terms and Conditions (GTC). It is important to note that PECHE-CHASSE is not able to manufacture the products and only engages in resale activities. Therefore, PECHE-CHASSE may use external professionals for the production, packaging, shipping, and storage of the products, which the Customer acknowledges and accepts.

It should also be noted that these conditions may be subject to modifications. Therefore, the applicable conditions are those in force on the website at the time of the contract formation.

In the context of this sale, PECHE-CHASSE undertakes to provide products that comply with current standards and regulations. The Customer must ensure the compatibility of the products with their needs and their use in accordance with the manufacturer’s instructions.

In the event of a dispute, the parties agree to seek an amicable solution before any legal action. In case of failure of negotiations, the competent courts will be those of the jurisdiction where the registered office of PECHE-CHASSE is established.

Article 2 – Legal Capacity

Customers affirm that they have reached the age of majority and have all the necessary legal capacity to enter into a contract. Parents or legal guardians are responsible for purchases made by minors.

Article 3 – Geographic Areas

The products and services offered are exclusively intended for customers located in Europe, including the European Union, as well as other specified geographic areas at the time of ordering. Any sale outside of these geographic areas must be expressly validated by INNOV-TECH during the ordering process. Customers are invited to contact our customer service for any delivery requests outside the mentioned geographic areas.

Article 4 – Prices of Products for Sale

The prices indicated on the website peche-chasse.fr are in euros and displayed excluding taxes (HT). In accordance with Article 293 B of the General Tax Code and the VAT exemption scheme applicable to our company, no VAT amount is added to the prices of the products. It should be noted that the sales prices of the products may be subject to changes at any time by our company. Any price variations will immediately apply to ongoing orders, unless they have already been confirmed by the customer. Customers will be informed of price variations through notifications on the website.

Article 5 – Articles and Products

The products presented on the website peche-chasse.fr are subject to limited availability based on the stocks available. If a product is not available from us and our suppliers, PECHE-CHASSE undertakes to immediately inform the buyer by email or phone. The buyer will then have the option to choose another product or cancel their order and receive a refund. PECHE-CHASSE strives to describe the products offered for sale as accurately as possible. Before placing an order, the Customer can consult the essential characteristics of the products they wish to purchase on the PECHE-CHASSE website. However, in the event of errors in this presentation, PECHE-CHASSE shall not be held liable. The illustrations and photos of the presented products do not constitute a contractual part. PECHE-CHASSE’s liability cannot be based on these descriptions, illustrations, or photos. In addition, information on any warranties provided by the manufacturers of the products sold is included, in addition to the legal guarantees.

Article 6 – Orders

Once the Customer definitively validates their order by clicking the “Validate your payment” button, they are considered to have knowingly accepted the content, delivery terms, and conditions of the order, as well as the GTC, prices, quantities, descriptions, characteristics, volumes, and delivery times of the products ordered on the website.

PECHE-CHASSE will send an order confirmation via email to the Customer. However, PECHE-CHASSE reserves the right to cancel or suspend the execution of an order or its delivery, regardless of its nature and stage of execution, in the event that it is impossible to debit the Customer’s bank account for their order or any amount due by the Customer, or in case of payment incident or fraud or attempted fraud related to the use of the PECHE-CHASSE website, including previous orders.

If the email address provided by the Customer during registration is incorrect and the Customer does not receive the confirmation email sent systematically by PECHE-CHASSE, PECHE-CHASSE cannot be held responsible. The sale will be considered final unless PECHE-CHASSE intentionally decides to cancel it, for example, in the event of out-of-stock products. However, the Customer has the right to withdraw within 14 days following the date of the order and delivery.

Article 7 – Payments

The Customer has the option to pay for their order by credit card directly on the website, using a Visa, Eurocard, or Mastercard. Please note that payment methods such as bank transfer and cash on delivery are not accepted.

The total amount of the invoice will be debited from the Customer’s account on the payment date.

Article 8 – Delivery

Delivery Areas

The products and services offered are exclusively intended for customers located in Europe, including the European Union, as well as other specified geographic areas at the time of ordering. Any sale outside of these geographic areas must be expressly validated by INNOV-TECH during the ordering process.

Delivery Terms

The ordered products will be delivered to the Customers at the address provided in the “My Account” form filled in by the Customer during registration. In the event of a change of address, it is the Customer’s responsibility to notify it before placing an order by modifying their details on the “My Account” form. For all products, delivery will be made no later than within 30 working days after order validation (if the products are available in stock). The customer will be delivered to their home according to their choice at the time of payment.

Depending on our stocks and the availability of our products, we may use a foreign external supplier. In this case, our parcels may be sent by an external provider operating within or outside the European Union, solely for the purpose of ensuring the delivery of the purchased products if the product is not available in our own warehouse.

Our company cannot be held responsible for any delivery delays caused by factors beyond our control, such as logistical problems or transportation disruptions. The indicated delivery time is for reference only and does not constitute a contractual commitment on our part.

Article 9 – Returns

Our company offers a 14-day return policy for purchased items. If 14 days have passed since the purchase, we cannot offer a refund or exchange.

To be eligible for a return, your item must be unused, undamaged, and in the same condition as when you received it. It must also be in its original packaging. Personalized or custom-made products are not eligible for return, except in the case of manufacturing defects.

Return costs are borne by the buyer, except for defective or non-compliant delivered products. Returns are covered only once from metropolitan France.

If you wish to make an exchange and the amount of your order is less than 250€, the return costs will be at your expense. Otherwise, the return costs will be covered by our company.

To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

Refunds (if applicable)

Once we receive your return and inspect it, we will send you an email to notify you that we have received your returned item. We will also notify you of our decision regarding the approval or rejection of your refund.

If your refund is approved, it will be processed, and a credit will automatically be applied to your credit card or original method of payment within a few days.

Late or Missing Refunds (if applicable)

If you haven’t received your refund yet, we recommend checking your bank account again. Then, contact your credit card company, as there may be a delay before the refund is officially posted.

If you have followed these steps and still have not received your refund, please contact your bank. There may be a processing time before the refund is posted.

Exchanges (if applicable)

It is possible to exchange a product within a maximum of fourteen (14) days following the receipt of the order. If the exchanged product is more expensive than the original order, an invoice with a payment link will be sent to you by email. Upon receipt of the missing amount, we will proceed with the shipment of the new order.

If you exchange your item for a cheaper one, the difference will be refunded to you, except for shipping costs.

Shipping

To return your product, you should mail it to the following address: INNOV-TECH (TURYK Mark), 35 Av. du Puy de Dôme, 63100 Clermont-Ferrand, France.

If you reside in France and outside metropolitan France, you will be responsible for paying for your own shipping costs for returning your item.

Please note that if you request a refund, return shipping costs will not be refunded even if we handle the return. If a refund is granted, the return shipping costs will be deducted from your refund.

Any customs duties and taxes incurred when returning a product from outside the European Union are the responsibility of the customer.

Additionally, the shipping time for your exchanged product may vary depending on your location.

Article 10 – Rights and Withdrawal Period

In accordance with current legal provisions, the Customer has a period of fourteen (14) days from the receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties, except for the return costs, which remain their responsibility.

The Customer may exercise their right of withdrawal by notifying their decision to withdraw through an unambiguous statement. This declaration can be made by any means, including postal or electronic mail, using the withdrawal form available at the following address: [Form for Withdrawal from PECHE-CHASSE].

To meet the withdrawal deadline, it is sufficient for the Customer to transmit their communication regarding the exercise of the right of withdrawal before the withdrawal period expires.

In the event of exercising the right of withdrawal, PECHE-CHASSE will proceed with the refund of the returned products, as well as the initial standard delivery costs, without undue delay and, in any case, no later than fourteen (14) days from the day PECHE-CHASSE is informed of the Customer’s decision to withdraw. PECHE-CHASSE may defer the refund until the products are received or until the Customer provides proof of shipment of the products, with the date chosen being the earlier of these facts.

The products must be returned to PECHE-CHASSE without undue delay and, in any case, no later than fourteen (14) days after the Customer has communicated their decision to withdraw. This deadline is deemed to be met if the Customer returns the products before the expiration of the fourteen (14) day period. The direct costs of returning the products are borne by the Customer.

The right of withdrawal does not apply, in particular, to products that are liable to deteriorate or expire rapidly, sealed products that are unsuitable for return for reasons of health protection or hygiene if they have been opened after delivery, or products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection.

In the event of a partial withdrawal from an order entitled to a quantity discount, the discount will be canceled if the withdrawal applies to only part of the products covered by the promotional offer.

Article 11 – Legal Guarantees

All products sold by PECHE-CHASSE are covered by the legal warranty of conformity and the warranty against hidden defects, in accordance with the provisions of Articles 211-4 et seq. of the Consumer Code and Articles 1641 et seq. of the Civil Code. These guarantees take effect from the date of delivery and cover both hidden and apparent defects.

PECHE-CHASSE’s liability under these warranties is limited, at its sole discretion, to free replacement or repair of the recognized defective products, without any other provision or compensation.

It should be noted that the warranty does not cover damage resulting from improper use of the product, normal wear and tear due to its use, or non-compliance with washing and maintenance instructions. To benefit from the warranty, it is imperative to keep the purchase invoice and the delivery note.

At PECHE-CHASSE, we strive to guarantee the quality and durability of our products. We encourage our customers to contact us in case of any issues with any of our products so that we can find a satisfactory solution.

Article 13 – Privacy

This privacy policy describes how your personal information is collected, used, and shared when you visit or make a purchase on the website peche-chasse.fr (hereinafter “the Platform”).

Article 14 – Responsibilities

The company INNOV-TECH declines all responsibility for any event, inconvenience, or damage inherent to the use of the Internet network, particularly in the event of a service interruption, external intrusion, or presence of computer viruses.

Furthermore, INNOV-TECH cannot be held responsible for the non-performance of the contract in the event of fortuitous events, force majeure, disruption, or total or partial strike, particularly in postal services, transportation and/or communication means, flood, or fire. INNOV-TECH shall not be liable for any indirect damages arising from these General Terms and Conditions, such as loss of business, loss of profit, damages, or costs that may arise.

Article 15 – Jurisdiction

In the event of a dispute that cannot be resolved amicably between the professional and the consumer, the parties agree to seek an amicable solution before initiating legal action. If no amicable solution is found, the competent courts will be those of the jurisdiction where the registered office of PECHE-CHASSE is established.

Furthermore, in the event of a cross-border dispute within the European Union, the consumer can use the European Online Dispute Resolution (ODR) platform available at the following address: [ODR Platform]. The ODR platform allows consumers to submit their disputes online and forward them to the competent mediation bodies.

The parties agree to comply with the mediation process and provide all necessary information to facilitate the amicable settlement of the dispute. Any costs related to the mediation will be borne in accordance with the provisions of the mediation body.

The decision of the mediator is binding on the parties, unless they decide to resort to legal proceedings.

This mediation clause does not affect the consumer’s legal rights to resort to legal proceedings or the right of the professional to take appropriate legal measures to protect their interests.

Article 16 – Intellectual Property Rights

Trademarks, domain names, products, software, images, videos, texts, or more generally any information related to intellectual property are and shall remain the exclusive property of INNOV-TECH. These GTC do not provide for any transfer of intellectual property rights. Any reproduction, modification, or use, in whole or in part, of these assets is strictly prohibited. Some photos are provided by our supplier, while others are royalty-free images.

Article 17 – Modification of the GTC

The company INNOV-TECH reserves the right to unilaterally modify these General Terms and Conditions of Sale at any time. Customers will be notified of any modifications to the General Terms and Conditions of Sale through direct communication, such as an email and/or by publishing the modifications on the company’s website. It is the responsibility of customers to regularly consult the General Terms and Conditions of Sale to be informed of any possible modifications. The continued use of the website after the publication of the modifications or after receiving the notification constitutes tacit acceptance of these modifications.
